Why doesn't the card get offered to the next highest bidder in these situations where the winning bidder refuses to pay?

Seller's choice, not required. Tho I have been the beneficiary in this scenario a few times.

Ditto to that scenario. It's happened to me a few times in the past as well. But I usually declined because the "winning bidder" that refused to pay had bid me up multiple times before they "won" the auction. Smells like a rat and I'm not the cheese.

if 10 percent of cards on ebay are counterfeit, i'm guessing that graded cards would all be legit ? Is it possible to get scammed with a graded card ?

I have seen similar things happen on eBay and I suspect these kinds of sellers just have a second eBay account under their spouse's name or whatever so they can bid on their own stuff when it doesn't sell for as much as they'd like. It's definitely against their ToS to do that and it couldn't hurt to report them to eBay if you suspect they're breaking the rules.

It's not likely, but it is possible. Cases can be opened and the card replaced with a lower condition card or the label replaced from a card that graded better. It is quite difficult to do, but it's possible. The reason someone would do this is pure greed. If they can sell a lower condition card for the higher graded price, they can re-submit the card that got the original grade for a new slab. It can't be done with SN cards though, IF the actual SN is on the label.

I recently had a buyer return a card to me because it didn't get to him "fast enough." It was literally delivered the next business day (paid on Friday, delivered on Monday). Buyers re-list stuff all the time for wide variety of reasons. I don't see anything shady with re-listing an item four days after another auction ended. That's the minimum length of time that eBay makes a seller wait if a buyer bids on an item and then never contacts the seller/pays for the item.

Maybe he did, maybe he didn't. In the end, you can bid what you're willing to pay and see if you get it the second time around. Or you can decide to never buy from this seller because your suspicious, probably rightly so.
You might want to report to eBay. They might look into it. Nothing major is likely to happen.
I'm not a huge eBay buyer, and even less frequent seller, but I've never had a significant problem on either end. Yet.

Yes, some slabs are very easy to open.
