I've experienced my first bad Ebay purchase.
I ordered a card on Sept. 1 and on the 6th I sent a message to the sellling asking when he might be sending. He told me his uncle died and would be mailing it on the upcoming Tuesday (The 8th). On Thurs the 10th, I asked him again, and he said that he would mail it on Friday the 11th, because he had to locate the card.
In my second message I asked for a refund as well, but he promised it would be mailed.
Is there a way to complain to Ebay? Can they fix this issue?

I'd give him a few more days (let's say the 15th) before complaining to ebay. Doesn't sound like any fraud going on there (yet)
And yes, you can open a case with ebay and they'll contact the seller on your behalf. If they find the seller isn't being cooperative, or the seller decides to cancel the order, they'll offer a refund.

Sounds like you have an unorganized seller. I'd give him 2 weeks, then release the hounds.

Its a bad eBay experience, but it doesn't sound like anything funny is going on (as BigEd put it.. yet). Just sounds like a disorganized/distracted/careless seller.

Just remember that eBay sides with the buyer 99% of the time which is why I stopped seling on eBay....Seems a bit weird that he sold a card but now has to locate it? How'd he take a picture of it to post for the auction?

Check his feedback and see if others have had the same experience recently. If not, be patient. If so, go ahead and report it so you can get your money back.

I recently bought a 1950 bowman card, and a couple of hours later told me he couldn't locate it. Within a few hours he refunded the purchase on his own.
It was disappointing, but at least I didn't have to wait long.

In eBay there will be an option to request a refund on the purchase page for the auction. This guy has given you a couple of standard responses where you know they are lying. There is the "Sorry my (insert various family member here) died" or "I have to find the card".
